My daughter (24) and her boyfriend filed common law this year on their taxes. They knew it would reduce their refund marginally but felt it was worth it.
So today they get a letter from the Ontario Tax people that they want $300 for 2009.
WTF? They were told they had to prove they were not common law at the time. It would seem to me that the onus should be on the tax people to prove they WERE common law at the time.
Nobody does tax grab like Ontario.
How ridiculous to back tax two entry level young people who finally decide that thier relationship is permanent and follow the law and file accordingly. Ive advised them to fight it. Its only $300 and they COULD probably come up with that money, but they shouldn't have to.
